Maalesef ayn\u0131 ismi ta\u015f\u0131d\u0131\u011f\u0131m\u0131z Amsterdam \u00dcniversitesi \u00f6\u011fretim g\u00f6revlisi Dr. Ahmet Akg\u00fcnd\u00fcz ve nihayet T\u00fcrkiye\u2019den destek ald\u0131klar\u0131 Marksist ve PKK\u2019nin yay\u0131n organlar\u0131nda yazarl\u0131k yapan bir tezv\u00eer\u00e2t\u00e7\u0131, ile y\u0131llard\u0131r s\u00fcrd\u00fcrd\u00fckleri Prof. Akg\u00fcnd\u00fcz\u2019\u00fc y\u0131pratma ve \u0130UR\u2019yi h\u0131rpalama projelerine, bu sefer \u015fahs\u0131mla alakal\u0131 intihal iddialar\u0131n\u0131 arka planda y\u00fcr\u00fcterek ve yanlar\u0131na PKK\u2019l\u0131lar ile Hollandal\u0131 baz\u0131 gazetecileri alarak devam ediyorlar. Bunun <em>Volkskrant<\/em> gibi, \u0130slam ve T\u00fcrk d\u00fc\u015fmanl\u0131\u011f\u0131n\u0131 adet haline getiren bir Hollanda Gazetesinde yay\u0131nlanmas\u0131 ise manidard\u0131r.<\/p>\n<p><strong>\u00d6nce dayand\u0131klar\u0131 olaylar\u0131 g\u00f6relim:<\/strong><\/p>\n<p><strong>1991: <\/strong>Bilindi\u011fi gibi, <em>Vak\u0131f M\u00fcessesesi <\/em>adl\u0131 T\u00fcrk Tarih Kurumu taraf\u0131ndan yay\u0131nlan eserimiz hakk\u0131nda hakaret-\u00e2miz bir tan\u0131t\u0131m yaz\u0131s\u0131n\u0131, <em>Tarih ve Toplum <\/em>Dergisinde Hasan Y\u00fcksel isimli bir \u015fah\u0131s yay\u0131nlad\u0131. Cevap g\u00f6ndermemize ra\u011fmen ne\u015fretmedi.<\/p>\n<p><strong>Ali Birinci denen ve gazetelerde T\u00fcrk Tarih Kurumundan milyonlar \u00e7ald\u0131\u011f\u0131 iddialar\u0131n\u0131 okudu\u011fumuz adam, <\/strong>ayn\u0131 iddialar\u0131 baz\u0131 dergilerde tekrarlad\u0131.<\/p>\n<p><strong> 25 eyl\u00fcl 2006\u2019da<\/strong>, s\u00f6zde Ermeni soyk\u0131r\u0131m\u0131 iddialar\u0131n\u0131n savunucusu Amsterdam \u00dcniversitesi \u00f6\u011fretim g\u00f6revlisi olan ve 1997 y\u0131l\u0131nda g\u00f6nderdi\u011fi bir e-mail ile benden nefret etti\u011fini s\u00f6yleyen bir adam\u0131n b\u00fct\u00fcn Hollanda\u2019daki akademisyenlere g\u00f6nderdi\u011fi e-maildir. \u015eu anda elimizdedir.<\/p>\n<p>Bu yerli ve yabanc\u0131 s\u00f6zde ilim adamlar\u0131n\u0131n bana olan h\u00fccumlar\u0131n\u0131n iki sebebi var:<\/p>\n<p>&nbsp;<\/p>\n<p>B\u0130R\u0130NC\u0130S\u0130: VAKIF M\u00dcESSESES\u0130<\/p>\n<p>Ancak kitap ne\u015fredildikten sonra bize ula\u015fanlar aras\u0131nda iki \u00f6nemli tenkit yer almaktad\u0131r:<\/p>\n<p><strong>Birinci Tenkit:<\/strong> Bir Dergide ve bundan iktibasla g\u00fcnl\u00fck bir Gazete \u2019de eserimizle ilgili bir tenkit yay\u0131nland\u0131. <em>Kitabiyat<\/em> b\u00f6l\u00fcm\u00fcnde ne\u015fredilen ve maalesef mu\u011falatalarla dolu olan bu g\u00f6r\u00fcn\u00fcrde ciddi, ancak vak\u0131f hukuku ve ilm\u00ee \u00f6l\u00e7\u00fcler a\u00e7\u0131s\u0131ndan ind\u00ee tenkide cevap vermenin zaruretini bir ara\u015ft\u0131rmac\u0131 olarak hissettim ve iddialar\u0131 cevapland\u0131rmak \u00fczere cev\u00e2b\u00ee yaz\u0131 haz\u0131rlad\u0131m. Hedefimiz ilme hizmet ve r\u0131z\u00e2y-\u0131 il\u00e2h\u00ee olmas\u0131 hasebiyle, sadece vak\u0131f hukuku a\u00e7\u0131s\u0131ndan yap\u0131lan f\u00e2hi\u015f hatalara de\u011findim ve gerisini ara\u015ft\u0131rmac\u0131lar\u0131n ve vak\u0131f hukuku uzmanlar\u0131n\u0131n takdirlerine havale eyledim. Cev\u00e2b\u00ee yaz\u0131y\u0131 buraya aynen iktibas etmek yerine, baz\u0131 hakikatleri aktarmak istiyorum.<\/p>\n<p><strong>1)<\/strong> \u0130lim, kar\u015f\u0131l\u0131kl\u0131 tenkit ve tart\u0131\u015fmalarla geli\u015fir. Ancak bu tenkit ve tart\u0131\u015fmalar\u0131n, \u00f6n yarg\u0131s\u0131z ve meseleyi bilen ehil insanlar taraf\u0131ndan yap\u0131lmas\u0131 icap etmektedir.<\/p>\n<p><strong>2) <\/strong>Biraz \u00f6nce de hat\u0131rlatt\u0131\u011f\u0131m\u0131z gibi, <em>\u201cVak\u0131f<\/em><em> M\u00fcessesesi<\/em>\u201d adl\u0131 eserimizin en \u00f6nemli \u00f6zelli\u011fi, sadece eski f\u0131k\u0131h kitaplar\u0131nda anlat\u0131lan vak\u0131fla ilgili \u015fer\u2018i h\u00fck\u00fcmlerin aktar\u0131lmas\u0131 de\u011fil, ayn\u0131 zamanda Osmanl\u0131 tatbikat\u0131n\u0131 da aksettirmesidir. Say\u0131n Tenkit\u00e7i, sadece nazar\u00ee a\u00e7\u0131dan de\u011fil, Osmanl\u0131 tatbikat\u0131 a\u00e7\u0131s\u0131ndan da kitab\u0131 incelemekten mahrum kalm\u0131\u015ft\u0131r veya \u00f6yle g\u00f6stererek maalesef mu\u011falata yolunu tercih etmi\u015ftir. Tenkit yaz\u0131s\u0131n\u0131 okuyanlar, kitab\u0131m\u0131z\u0131n, sadece El-K\u00fcbeys\u00ee\u2019nin kitab\u0131n\u0131n bir \u00f6zeti oldu\u011fu iddias\u0131yla kar\u015f\u0131la\u015f\u0131rlar. H\u00e2lbuki, kitab\u0131m\u0131z\u0131n vak\u0131f hukukunun ic\u00e2reteyn, gayr-\u0131 sahih vak\u0131flar, gedik hakk\u0131 ve benzeri istisnalar\u0131n\u0131 konu edinen k\u0131s\u0131mlar\u0131; nakit para mevzuunu inceleyen k\u0131s\u0131mlar\u0131; vak\u0131f \u00e7e\u015fitleri ile ilgili sayfalar\u0131; vak\u0131f g\u00f6revleri ve vak\u0131f te\u015fkilat\u0131yla alakal\u0131 b\u00f6l\u00fcmleri ve benzeri bir\u00e7ok mevzular, b\u0131rak\u0131n\u0131z El-K\u00fcbeys\u00ee\u2019nin eseri, \u0130sl\u00e2m Hukuku kaynaklar\u0131nda da bir iki c\u00fcmle ile ge\u00e7i\u015ftirilen konulard\u0131r. Yani eserimizin hemen hemen yar\u0131s\u0131, tamamen Osmanl\u0131 Hukukunda ve tatbikat\u0131ndaki hususi meselelere ayr\u0131lm\u0131\u015ft\u0131r ve geriye kalan k\u0131sm\u0131n %30\u2019unda da Osmanl\u0131 uygulamas\u0131 \u00f6zel ba\u015fl\u0131klar alt\u0131nda incelenmeye \u00e7al\u0131\u015f\u0131lm\u0131\u015ft\u0131r. Daha \u00f6nce yap\u0131lan \u00e7al\u0131\u015fmalardan istifade etmeyi, eskiyi aynen iktibas \u015feklinde de\u011ferlendirmek yap\u0131lacak ilm\u00ee \u00e7al\u0131\u015fmalarda, daha \u00f6ncekilerinden hi\u00e7 istifade etmemek demektir.<\/p>\n<p><strong>3) <\/strong>Say\u0131n tenkit\u00e7inin, eserimizin tamam\u0131n\u0131 da okumad\u0131\u011f\u0131 kanaatindeyiz. Zira \u201c<strong><em>Metot ve Kaynaklar<\/em>\u201d<\/strong> k\u0131sm\u0131nda, \u0130sl\u00e2m Hukuku ile alakal\u0131 mu\u2018\u00e2s\u0131r eserler aras\u0131nda, El-K\u00fcbeys\u00ee\u2019nin iki ciltlik k\u0131ymetli eserinin temel kaynaklar\u0131m\u0131z aras\u0131nda oldu\u011funu belirtti\u011fimiz gibi, paragraf\u0131n son c\u00fcmlesinde de aynen \u015funu ifade etmi\u015fiz: <em>\u201c\u0130sl\u00e2m Hukukunda mezheplere ait g\u00f6r\u00fc\u015flerin derlenmesi ve de\u011ferlendirilmesi konusunda, mu\u2018\u00e2s\u0131r \u0130sl\u00e2m hukuk\u00e7ular\u0131n\u0131n yazd\u0131klar\u0131 eserlerden yararlan\u0131lm\u0131\u015ft\u0131r\u201d.<\/em> Elbetteki bu yararlan\u0131lan eserler aras\u0131nda, iki ciltlik El-K\u00fcbeys\u00ee\u2019nin eseri de olacakt\u0131r ve olmamas\u0131, bizim ilmi anlay\u0131\u015f\u0131m\u0131za g\u00f6re b\u00fcy\u00fck bir eksikliktir. Bu istifadeye, ebetteki baz\u0131 konular\u0131n tasnif ve sistemati\u011fi de d\u00e2hildir. De\u011ferli \u0130sl\u00e2m Hukuk\u00e7usu Hayreddin Karaman\u2019\u0131n\u201d<em> mukayeseli \u0130sl\u00e2m Hukuku<\/em>\u201d adl\u0131 eserinin III. cildinde Devletler \u00d6zel Hukuku b\u00f6l\u00fcm\u00fcnde Abd\u00fclkerim Zeydan\u2019\u0131n konuyla ilgili eserinden yararlanmas\u0131; \u0130zmirli \u0130smail HAKKI\u2019n\u0131n \u0130lm-i Hilaf adl\u0131 eserinde yine konuyla ilgili eserlerin tasnifini aynen taklit etmesi, eksiklik de\u011fil, b\u00fcy\u00fck bir ilmi bir meziyettir. Zira ink\u00e2r s\u00f6z konusu de\u011fildir. Sadece El-K\u00fcbeys\u00ee\u2019nin eserinden de\u011fil, vak\u0131fla ilgili Osmanl\u0131 Hukuk\u00e7ular\u0131n\u0131n temel kitaplar\u0131ndan da, hemen hemen her sayfada yararlanmaya gayret ettik. Sonu\u00e7 b\u00f6l\u00fcm\u00fcnde bunu \u00f6zellikle tekrar ettik: <em>\u201cDaha \u00f6nce yap\u0131lm\u0131\u015f olan \u00e7al\u0131\u015fmalar\u0131 tamamlamaya \u00e7al\u0131\u015ft\u0131k. Uzun ve d\u00fczensiz olan vak\u0131f hukuku mevzuat\u0131 ve doktrinini bir araya getirmeye ve d\u00fczenlemeye \u00e7al\u0131\u015ft\u0131k<\/em>\u201d. Yani \u0130sl\u00e2m Hukukundaki mezheplerin g\u00f6r\u00fc\u015flerinin tedv\u00eeni yap\u0131l\u0131rken, El-K\u00fcbeys\u00ee\u2019nin iki ciltlik dev eserinden yararlan\u0131ld\u0131\u011f\u0131 gibi, ayn\u0131 mevzular\u0131 benzeri bir sistematikle inceleyen Ebu Zehra\u2019n\u0131n eserinden ve \u00f6zellikle Zekiyy\u00fcddin \u015ea\u2019ban ve Ahmed El-Gandur\u2019un k\u0131ymetli eserlerinden de yararlan\u0131lm\u0131\u015ft\u0131r. Mezheplerin g\u00f6r\u00fc\u015fleri h\u00fcl\u00e2sa edilirken yap\u0131lan i\u015f \u015fudur: Evvela bu konuda yaz\u0131lm\u0131\u015f mu\u2018\u00e2s\u0131r eserlerin muhtev\u00e2s\u0131ndan yararlanmak, imk\u00e2n varsa bunlar\u0131n ula\u015ft\u0131\u011f\u0131 veya ula\u015famad\u0131\u011f\u0131 kaynaklar\u0131 bizzat g\u00f6rmek; bu da m\u00fcmk\u00fcn de\u011filse mu\u2018\u00e2s\u0131r eserler kaynak al\u0131narak ve onlara at\u0131f yap\u0131larak onlar\u0131n kaynaklar\u0131na da i\u015faret eylemek.<\/p>\n<p>\u015eunu da \u00f6nemle ifade edelim ki, mu\u2018\u00e2s\u0131r fakihlerin kaynaklar\u0131 tetkik edilirken, onlar\u0131n maalesef g\u00f6remedi\u011fi, Osmanl\u0131 Hukuk\u00e7ular\u0131n\u0131n \u00e7al\u0131\u015fmalar\u0131 da sat\u0131r sat\u0131r takip edilmi\u015ftir. Bed\u00ee\u00fczzaman\u2019\u0131n ayak bast\u0131\u011f\u0131 her yeri ve konu\u015ftu\u011fu her \u015fahsiyeti ad\u0131m ad\u0131m ve \u015fah\u0131s \u015fah\u0131s dola\u015farak bu eserleri meydana getirmi\u015ftir. B\u00fct\u00fcn Nur Cem\u00e2\u2019ati ona medy\u00fbn-u \u015f\u00fckrand\u0131r.<\/p>\n<p><strong><em>\u0130kincisi<\/em><\/strong><em>, Abd\u00fclkadir Bad\u0131ll\u0131<\/em><em> A\u011fabey\u2019<\/em>dir. Hem \u00fc\u00e7 b\u00fcy\u00fck ciltten olu\u015fan <em>Mufassal<\/em><em> Tarih\u00e7e-i Hayat<\/em><em>, <\/em>hem <em>Ris\u00e2le-i Nur<\/em><em>\u2019un Kuds\u00ee Kaynaklar\u0131<\/em> muhalled eserler olup ancak ve ancak istihd\u00e2m-\u0131 ilah\u00ee ile v\u00fccuda getirilebilinecek eserlerdir. Bu \u00e7al\u0131\u015fmay\u0131 kaleme alabilmek i\u00e7in, 60 sene Bed\u00ee\u00fczzaman ile alakal\u0131 ya\u015fanm\u0131\u015f olaylar\u0131 ve h\u00e2t\u0131ralar\u0131, belge ve bilgileri toplamak ve takip etmek gerekmektedir. Ayr\u0131ca Ris\u00e2le-i Nur M\u00fcellifinin eski ve yeni b\u00fct\u00fcn eser ve lahikalar\u0131na hem sahip olmak ve hem de tam v\u00e2k\u0131f olmak icabetmektedir.
